Plain English summary: Use Peak to genuinely improve your life. Don't misuse it or try to break it. We own the app and its content; you own your personal data. If something goes wrong, our liability is limited to the amount you paid us.
By downloading, installing, or using the Peak app ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms apply to all users of Peak, including the iOS application and the website at peakapp.org.
Peak is a self-improvement application that gamifies real-world goal achievement. Users complete real-world tasks across life areas including fitness, finance, career, relationships, mindset, and habits. Completing tasks earns XP, coins, and unlocks hand-painted world environments. The app includes an AI Life Coach powered by artificial intelligence to provide personalized guidance.
You must be at least 13 years old to use Peak. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the App.
You are responsible for maintaining the confidentiality of your account and all activity that occurs under it. You agree to:

The Peak app, including all software, designs, graphics, world artwork, copy, branding, and AI models, is owned by Peak and protected by intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
You retain ownership of the personal content you create within the app (goals, journal entries, task lists). By submitting content to Peak, you grant us a limited, non-exclusive license to use that content solely to operate and improve the App.
The Peak AI Life Coach provides personalized suggestions and guidance based on your goals, habits, and progress. This advice is for informational and motivational purposes only. It does not constitute professional medical, financial, legal, or therapeutic advice. Always consult a qualified professional for decisions in these areas. Peak is not liable for any actions you take based on AI Coach recommendations.
XP, coins, Life Score, levels, and world unlocks are virtual items with no monetary value and cannot be exchanged for real money, goods, or services outside the App. Peak reserves the right to adjust, modify, or remove virtual items and reward systems at any time.
We strive to keep Peak available at all times but do not guarantee uninterrupted access. We may update, modify, or discontinue features with or without notice. We are not liable for any loss resulting from downtime, updates, or changes to the App.
Peak may integrate with or link to third-party services (such as Apple's App Store, analytics providers, or AI infrastructure). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
Peak is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, secure, or continuously available.
To the fullest extent permitted by law, Peak and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
We reserve the right to suspend or terminate your access to Peak at any time, with or without notice, if we believe you have violated these Terms. You may stop using the App at any time by deleting it from your device. To request account deletion, contact support@peakapp.org.
We may update these Terms from time to time. We will notify you of material changes via the App. Continued use of Peak after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
